India's spirit of jugaad is finally going to get legal backing. Innovators who have for long been dismissed as copycats or blamed for piracy would soon get intellectual property rights, at par with patents, with the industry department going to move a bill.

The move to grant 'petty patents' or 'innovation patents', also called utility models, follows a near strong support to a proposal floated by the department of industrial policy and promotion, at least from domestic players. The idea was to give intellectual property rights to the small scale industry's innovations that lead to inventions which do not strictly conform with patent laws.

Under the Patents Act, protection is granted if there is novelty, inventive step and industrial application. It is denied in case there is a mere discovery of new forms of known substances, rearrangement or duplication of devices and inventions due to traditional knowledge.

Agencies such as Defence Research & Development Organisation ( DRDO) have told the department that development of weapons systems and platforms for services, with dual use applications, stand to benefit.

Similarly, the science and technology department has supported the move and suggested that the proposed protection be made available for 8-10 years.

The biotech department has argued that petty patents should be granted to mechanical devices, including those for patient care, some chemicals and industrial designs.

But global giants such as Intel have opposed the move and have argued that if at all protection is provided, it should be limited to mechanical devices and not for high-tech devices. "No, there is no overwhelming need/ empirical data to support the position that India today needs a utility model law," said Matrix Labs, a subsidiary of Mylan Inc, which is one of the world's largest player in the bulk drugs space.

Japanese companies, which have submitted a joint feedback to the government, have argued that protection against potential misuse should be built in.

While officials said that work on preparing the draft legislation was starting, the details would be thrashed out after further consultations. What is, however, certain is that industries such as pharmaceuticals and biotechnology would be kept out as the government does not want additional protection to affect public health. The science and technology ministry has said that only biomedical and pharma industry should get patent protection as large sums are pumped in for research and development.

By enacting a law that would boost protection of creeping and incremental innovations, India will join the league of over 50 countries ranging from Japan and Germany, which have had utility models for long, as well as China and the Netherlands that provided protection later.

"It is compliant with global intellectual property rights norms so we do not see any problem," government sources said.

In a discussion paper released in May, the department had listed several innovations ranging from clay refrigerator or Mitticool that does not use electricity, to gas stove switch, where the stove is switched off after a predetermined number of pressure cooker steam release whistles are sounded.

Since 2000, the National Innovation Foundation has built a database of over one lakh ideas, innovations and traditional knowledge practices from across the country and has filed for close to 200 patents in India and the US. Out of these, 33 patents have been granted to grassroots innovations in India and four in US.

The bill will provide a legal framework that offers quick, cheap, simple and non-demanding registration.

All that negativity isn't very much fun, for one thing. It's impossible to be very happy about things if you're filling your mind with worry, doom and gloom. It's also hard to see the good things that are already in your life if you're worrying about those things going away.

And the truth is the more you think negatively, the more negative effects you're going to see in your life. You might find that after a day of negativity you're actually feeling physically sick like you have a cold coming on. This isn't your imagination, it's a real physical manifestation of your negative thoughts, and a clear example of how we're able to influence our environment and what happens to us through our thoughts and feelings.

On the flip side we can also influence what happens to us in a positive way, though positive thinking and feelings. Focusing on the good that is already in our lives and thinking about the greater good that will come to us in the future, the goals we want to achieve and the things we want to have, will make more good things come into our lives.

The key is to focus on what it is that you want in your life, not what you don't want. Clearly we all want security, peace and stability in our lives, our jobs and our families, but all too often we think about what would happen if those things were taken away from us. We dwell on lost jobs, illness and divorce, and those negative thoughts and feelings just bring more negative energy into our lives.

If you want to feel more positive, think more positive thoughts. If you want more goodness in your life, think about the good things you have and how you'd like your life to be. Imagine a life that is calm, a job that provides all the money you need and a family that is happy, and that is what you will have.

Positive thinking isn't just a way to make you feel better in hard times (though it will do that). It's a concrete thing that you can do to turn your life around, no matter how crazily things are swirling around you.

Barnes & Noble stores to be first Angry Birds 'magic place,' exclusive to the Nook Color

If you happen to have a Nook Color and love Angry Birds, you're in for a treat.  Rovio and Barnes & Noble have teamed up and made B&N stores the very first "magic location" for the Angry Birds game.  All you have to do is play Angry Birds (the official Nook Color edition -- hackers with the Android Market version can't join the fun) while inside one of the 700 plus B&N stores and you'll unlock the Mighty Eagle character for free.  If you don't have a Nook Color, or aren't using the Nook Angry Birds app, you can still check it out and the Nook Color display at any B&N location.

It's part of Rovio's magic places based gameplay, which uses NFC, GPS, and Wifi location to unlock in-game content.  They have more planned, including an NFC phone fist-bump ritual that will unlock new levels.  To help understand it all a little better, check out the interview with Ramine Darabiha, product manager for Angry Birds Magic and the full press release after the break.

Just Ask Your Baker

During one of my biology classes in college we were asked to analyze the ingredients which were found in a simple, common, everyday food. Much to my surprise was one of the ingredients which I found contained in a loaf of bread.

Take any bread and read the ingredient list. For our sample we will use a generic 100 percent whole wheat bread. At first it sounds like it would be very beneficial for our health however upon reading the raw products list we quickly discover other wise. Ingredients on the bread wrapper state that it is made from the usual whole wheat flour, sugar, water, yeast, wheat gluten, soybean or canola oil, salt, citric acid, sodium and a host of other minor products, some being familiar while other may not so well-recognized.

One of the ingredients that caught my attention was something called azodicarbonamide. Azodicarbonamide is a product which is generally used in the manufacturing of PVC piping and it is an active agent in the foamed plastics and rubber industry. Typical products which contain this chemical include sealing gaskets, automotive padded floor mats, exercise mats and rubber shoe soles.

My first reaction to this chemical which I discovered in my loaf of bread was why is it used at all. I have found that generally anything put in food which is unpronounceable by the common person is not healthy for you. Unfortunately, I was proved correct in my assumption with this product. The World Health Organization has stated that azodicarbonamide is a respiratory sensitizer which is capable of causing drastic respiratory illnesses to workers who have been exposed to it.

Azodicarbonamide is in reality a synthetic chemical used as a human food additive. When used in this manner it is referred to as E927. We find this chemical used as not only a food additive, but as a flour bleaching agent as well. In effect it acts as an oxidizing agent and reacts accordingly with the moist flour of the dough.

As I noticed it being added to my bread my initial question was whether it is safe or not? The manufacturer of the bread places azodicarbonamide in the dough to maintain a spongy feeling in the final product. Further research has revealed that the chemical has been banned from many foreign countries as an unsafe addition to food. In Singapore if you are caught using this chemical in food you are liable for a fine of $450,000 dollars and a prison term of up to 15 years. Australia as well has placed a ban on this chemical as have most European nations. America so far has not placed any restrictions on this product and it is allowed to be added to human food at a rate of 45 parts per million.

In support of the idea that this chemical is unsafe in foods it is wrongly been proclaimed that azodicarbonamide completely decomposed into harmless chemicals during the baking process. This is simply not true and the final bread product is harmful to humans. It is believed that the primary reason that it is disapproved in European nations is because it is an oxidizer and as such if consumed it creates free radicals within the body which contribute to cancer formation. As health conscious people we should be up in arms with our government for allowing this hazardous chemical to be fed to our families in our food.

You may be asking yourself what you can do since bread is a mainstream staple around the world. First off, always read the package to see what chemicals are in the food you are about to buy. Stop purchasing and consuming any baked produce which contains azodicarbonamide. Avoid fast food establishments such as Subway, Burger King, Dunkin Donuts, McDonald's, KFC and the string of other fast food enterprise. Since you must have bread you are presented with several options. You can purchase the higher priced organic breads or you can simply bake your own.
