Jerry Springer was as surprised by his relatively long run on the third season of "Dancing With the Stars" as the viewers were. That turned out to be a simple error, and he did last six more weeks into the competition. It was a good thing too, as one of the reasons he agreed to do the show was that it was a good excuse for him to finally learn the waltz. He wanted to know how so he could dance it with his daughter Katie at her wedding. He was thrilled that she was in the audience during that week of the competition, and even though he didn't win, at least he got to have that moment with his daughter at her wedding -- and not have two left feet during it.

Dems: Fast & Furious just 1 of 4 misguided probes (AP)

WASHINGTON ? Democrats looking into Operation Fast and Furious say a yearlong investigation has turned up no evidence that the flawed gun smuggling probe was conceived or directed by high-level political appointees at Justice Department headquarters.

The probe, the Democrats say, was just one of four such operations that were part of a misguided five-year-long effort, during both the George W. Bush and Obama administrations, in the Phoenix division of the Bureau of Alcohol, Tobacco, Firearms and Explosives against firearms trafficking along the Southwest border.

"Operation Fast and Furious was the latest in a series of fatally flawed operations run by ATF agents in Phoenix and the Arizona U.S. Attorney's Office," the report from Democrats on the House Oversight and Government Reform Committee says.

It is expected to differ sharply with the conclusions of Republicans, who will question Attorney General Eric Holder about Operation Fast and Furious at a hearing Thursday before the committee.

On Tuesday, Sen. Chuck Grassley, the ranking Republican on the Senate Judiciary Committee, said the idea that "senior political appointees have clean hands in these gun-walking scandals doesn't pass the laugh test ... They ignored the warning signs and failed to put a stop to it or hold anyone accountable. Lanny Breuer (assistant attorney general in charge of the criminal division) is a senior political appointee, and he admits to knowing about gun-walking as early as April 2010."

Beginning six years ago, according to the Democrats' report, ATF agents in Phoenix devised a strategy to forgo arrests against low-level straw purchasers of guns while attempting to build bigger cases against higher-level traffickers, a risky tactic known as gun-walking.

"The committee has obtained no evidence indicating that the attorney general authorized gun-walking or that he was aware of such allegations before they became public," said the Democrats' report, "Fatally Flawed: Five Years of Gunwalking in Arizona." "None of the 22 witnesses interviewed by the committee claims to have spoken with the attorney general about the specific tactics employed in Operation Fast and Furious prior to the public controversy."

Rather than halting operations after flaws became evident, the ATF's Phoenix division "launched several similarly reckless operations over the course of several years, also with tragic results," the report said. "Each investigation involved various incarnations of the same activity: Agents were contemporaneously aware of illegal firearms purchases, they did not typically interdict weapons or arrest straw purchasers, and firearms ended up in the hands of criminals on both sides of the border."

Operation Fast and Furious came to light following the December 2010 slaying of U.S. border agent Brian Terry near Nogales, Ariz. Two guns connected to suspects in the Fast and Furious investigation were found at the Terry murder scene.

Operation Fast and Furious was the fourth such ATF gun-walking probe, according to the Democrats' report, which was based on documents collected by the committee.

The first gun-walking probe, said the report, was Operation Wide Receiver, in which ATF agents, for over a year starting in 2006, watched traffickers buying guns from a gun dealer and driving them across the border into Mexico. According to a memo by William Newell, who was in charge of the Phoenix division at the time, one of the suspects told the gun dealer that the "firearms are going to his boss in Tijuana, Mexico, where some are given out as gifts." ATF officials believed they had sufficient evidence to arrest and charge the suspects, but as one agent said at the time, "we want it all," according to an email between two ATF supervisors in Arizona.

A year after Wide Receiver began, ATF initiated attempts to coordinate with Mexican officials. Numerous attempts at cross-border interdiction failed, according to the Democrats' report, with ATF agents expressing concern over the operation.

In a 2007 case, ATF agents targeted Fidel Hernandez and several alleged co-conspirators who purchased over 200 firearms and were believed to be transporting them into Mexico.

William Hoover, then ATF's assistant director of field operations, temporarily halted operations after being informed of several attempts at coordinating with Mexican law enforcement authorities.

The defendants were brought to trial in 2009, but acquitted after prosecutors were unable to obtain the cooperation of the Mexican law enforcement officials who had recovered firearms purchased by Hernandez.

In a 2008 case, ATF agents in Phoenix focused for a year on a network of illicit gun buyers who were purchasing weapons from the same gun dealer who had cooperated in Operation Wide Receiver.

Members of the network, led by Alejandro Medrano, were eventually sentenced to multiyear prison terms for trafficking more than 100 firearms to a Mexican drug cartel.

In Operation Fast and Furious, ATF agents in Phoenix late in 2009 identified a network of more than 20 straw purchasers believed to be trafficking military-grade assault weapons to Mexican drug cartels. Twenty people were charged in the case.

ATF Deputy Director William Hoover became concerned about the number of firearms involved in the case and ordered a strategy for the investigation to be brought to an end. Newell in Phoenix expressed frustration with ATF headquarters in Washington and "the operation continued to grow and expand rather than wind down over the months to follow," the Democrats' report said.

Many Repeat Breast Cancer Surgeries Could Be Unnecessary (LiveScience.com)

One in four women who undergo breast-conserving surgery to remove cancer will be called back for more surgery, a new study finds.

Moreover, the chance that a woman will have additional surgery varies greatly depending on where she gets it done and the surgeon that performs it, the researchers said. This suggests that some of these surgeries are unnecessary.

Because each surgery takes a physical, psychological and economic toll on patients and affects the course of cancer therapy, doctors need to come to better agreement on which patients require additional surgery and which do not, said study researcher Dr. Laurence McCahill, a surgeon at Michigan State University.

The study will be published tomorrow (Feb. 1) in the Journal of the American Medical Association.

Breast-saving surgery

About 60 to 75 percent of breast cancer patients undergo a partial mastectomy, which aims at conserving as much breast tissue as possible while still removing the tumor.

After an operation, doctors examine the edges of the excised tissue under a microscope, looking for clues as to whether they "got it all." If cancerous cells are found all the way up to the edge of the removed tissue, known as "positive margins," then it could be that some cancer is still inside the patient and she may require more surgery.

On the other hand, doctors can feel more comfortable that the cancer was completely removed if they see "negative margins," meaning there is a border of normal tissue, completely free of cancer cells, around the cancer they removed.

Exactly how big this border needs to be to prevent recurrence of the cancer is not known. And doctors can't tell at the time of surgery whether the margins on the tumor are positive or negative. "Our eyes are not microscopes," McCahill said.

McCahill and colleagues analyzed information from 2,206 women with invasive breast cancer who underwent a partial mastectomy at four hospitals between 2003 and 2008.

Of these, about 23 percent (509 patients) underwent re-excision surgery.

Surgeons seemed to agree that patients needed additional surgery if the tissue removed from them had cancer cells up to its edges ? of these patients, 85.9 percent had re-excision surgery.

However, among patients with clear borders of cancer-free tissue, the chance that they had additional surgery varied greatly. Some surgeons performed repeat surgeries for 70 percent of their patients; others never did re-excisions for these patients.

That may be because surgeons differ in how big of a cancer-free border they want their patients to have. Some may feel comfortable with a 1-millimeter border of cancer-free tissue, while others want a larger border, perhaps 2 or even 5 millimeters, and so would re-operate on patients with smaller borders.

Unnecessary operations

There is "no evidence" that these repeat surgeries prevent cancer from coming back, or bring longer lives for patients, said Dr. Monica Morrow, chief of breast surgery at Memorial Sloan-Kettering Cancer Center in New York City, who was not involved in the study.

In the absence of data indicating the benefit of repeat surgeries, a number of women may be having additional surgery unnecessarily, Morrow said.

If doctors accepted any cancer-free border as adequate and did not aim for a specific size border, the number of re-excisions could be significantly reduced, Morrow said.

More studies are needed to see if bigger margins do in fact provide a clinical benefit, Morrow said.

Obama to detail broader housing refinance plan (AP)

WASHINGTON ? The Obama administration is trying to fix a stubborn drag on the economy by allowing millions of more homeowners to refinance their mortgages at lower interest rates even if they owe more than their homes are worth, tackling a difficult issue of vital concern in states key to President Barack Obama's re-election.

Obama on Wednesday was to draw attention to a proposal he outlined in his State of the Union address to allow homeowners with privately held mortgages to take advantage of record low rates, for an annual savings of about $3,000 for the average borrower. Obama was detailing his plan during a visit to a northern Virginia community center.

The administration proposal faces a major hurdle in Congress. The program would cost between $5 billion and $10 billion, depending on participation, and would be paid for by a fee on large banks. The administration has tried unsuccessfully before to win support for such a tax on large banks.

The administration estimates that 3.5 million borrowers would have incentive to refinance under the new plan.

The plan would expand the administration's Home Affordable Refinance Program, which allows borrowers with loans backed by government-affiliated mortgage giants Fannie Mae and Freddie Mac to refinance at lower rates. About 1 million homeowners have used it, well short of the 4 million to 5 million the Obama administration had expected. Moreover, many "underwater" borrowers ? those who owe more than their homes are worth ? couldn't qualify.

The new administration plan would permit homeowners to refinance their mortgages into loans backed by the Federal Housing Administration. To qualify, borrowers with privately held mortgages would have to have no more than one delinquency in the six months preceding refinancing. Their loans would have to fall within the mortgage limits set by the FHA in their home counties.

Under the program, banks would have to reduce mortgage balances for homeowners who owe more than 140 percent of the value of their homes.

The features of the new proposal were confirmed Wednesday by a senior administration official who spoke on the condition of anonymity to discuss the program ahead of Obama's remarks. The Wall Street Journal first reported the details Wednesday.

The Obama administration also plans to announce new industry standards for mortgage servicers, a sort of "bill of rights" for borrowers that would protect them in their transactions.

Obama also is expected to announce a program that would allow the sale of foreclosed homes by Fannie Mae to investors who would then offer the properties for rental. Administration officials say there is a high demand for rental housing and such a program would also sustain neighborhoods by keeping foreclosed homes from falling into disrepair.

A punctured housing bubble was at the center of the recession, prompting widespread foreclosures and leaving millions of homeowners with houses valued at less than their mortgages. Hit hardest were Nevada and Florida, two states that figure prominently in the presidential campaign and that Obama is counting on winning to secure re-election.

Under the refinancing plan, any homeowner current on his or her mortgage could take advantage of historically low lending rates. The average rate for a 30-year mortgage is 3.88 percent.

About 11 million Americans ? roughly 1 in 4 with a mortgage ? are underwater, according to CoreLogic, a real estate data firm.

Half of all U.S. mortgages ? about 30 million home loans ? are owned by nongovernment lenders.
